Zoltify Returns & Refund Policy

Zoltify is an online technology retailer operated by a sole proprietor in South Africa.

This Returns & Refund Policy explains the circumstances in which customers may return products purchased from Zoltify and how refunds, replacements and repairs are handled.

This policy is intended to operate in accordance with applicable South African law, including the Consumer Protection Act 68 of 2008 (CPA) and, where applicable, the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

Nothing in this policy limits, excludes or waives any consumer right that cannot legally be limited, excluded or waived.

2. Your Consumer Rights

Zoltify respects the rights provided to consumers under South African law.

The Consumer Protection Act provides consumers with rights relating to the quality, safety, durability and suitability of goods.

Under section 56 of the CPA, qualifying goods carry an implied warranty of quality. Where goods fail to satisfy the applicable requirements within six months after delivery, the consumer may return the goods without penalty and at the supplier’s risk and expense. 3. When You Can Return a Product

You may be entitled to return a product where, for example:

  • The product is defective;
  • The product is unsafe;
  • The product is not in good working order;
  • The product is not reasonably suitable for its intended purpose;
  • The product does not correspond with its description;
  • The incorrect product was supplied;
  • The product is materially different from what you ordered; or
  • Another statutory right to return the product applies.

The specific remedy available will depend on the circumstances and applicable South African law.


4. Defective or Faulty Products

If a product is defective or fails to meet the quality requirements applicable under the CPA, please contact Zoltify.

For qualifying defects occurring within six months after delivery, the CPA provides an implied warranty of quality.

Where section 56 applies, you may return the product without penalty and at the supplier’s risk and expense.

Subject to the CPA, you may direct Zoltify to:

  • Repair the product;
  • Replace the product; or
  • Refund the price paid for the product.

5. Products That Become Defective After a Repair

If Zoltify repairs a product and, within three months after the repair, the same failure, defect or unsafe feature has not been remedied, or another failure, defect or unsafe feature is discovered, the CPA provides for further remedies, including replacement or a refund, subject to the Act. 6. Incorrect Product

If you receive a product that is different from the product you ordered, please contact us as soon as reasonably possible.

Please provide:

  • Your order number;
  • Your name;
  • A description of the issue; and
  • Photographs of the product and packaging where reasonably possible.

If Zoltify supplied the incorrect product, we will arrange an appropriate remedy.

Where the incorrect product was supplied because of an error by Zoltify, we will not unfairly require you to bear the cost of correcting our error.


7. Product Not as Described

If the product you receive is materially different from the description, specifications or representation made on our Website, please contact us.

We will investigate the matter and provide the applicable remedy required by South African law.

Nothing in this policy limits your statutory rights relating to goods that do not correspond with their description.


8. Damaged Products on Delivery

If your product arrives damaged, please contact Zoltify as soon as reasonably possible.

Where possible, please provide photographs showing:

  • The outer packaging;
  • The shipping label;
  • Any visible damage;
  • The product packaging; and
  • The product itself.

Please keep the original packaging until the matter has been resolved.

If the product is defective or damaged in circumstances for which Zoltify is legally responsible, we will provide the remedy required by applicable law.


9. Change-of-Mind Returns

A customer does not automatically have an unlimited statutory right to return a product simply because they have changed their mind.

However, certain South African laws provide specific cancellation or return rights in particular circumstances.

Where a statutory cancellation or return right applies, Zoltify will honour that right in accordance with the applicable legislation.


10. Electronic Transactions and Cooling-Off Rights

Because Zoltify sells products online, certain transactions may be subject to statutory cancellation rights under ECTA.

Where the applicable ECTA cooling-off provisions apply, a consumer may have a statutory right to cancel an electronic transaction within the applicable period, subject to the exceptions and requirements contained in the legislation.

Where a statutory cancellation right applies, Zoltify will process the cancellation and applicable refund in accordance with the law.

This statutory right is separate from the CPA’s remedies for defective or non-conforming goods.


11. Products That Cannot Reasonably Be Returned

Certain statutory cancellation rights may not apply to particular types of products or transactions.

Examples may include goods:

  • Made to the consumer’s specifications;
  • Personalised specifically for the consumer;
  • That cannot reasonably be returned because of their nature; or
  • Falling within another statutory exception.

Where an exception applies, we will apply the relevant law.

This does not remove any separate statutory rights the consumer may have because the goods are defective, unsafe or otherwise fail to meet applicable legal requirements.


12. Unused and Unopened Products

Where a return is permitted under a voluntary Zoltify return arrangement rather than a statutory right, we may require the product to be:

  • Unused;
  • In saleable condition;
  • Complete with all accessories;
  • Accompanied by its original packaging where reasonably possible; and
  • Accompanied by proof of purchase.

These requirements do not apply in a manner that restricts statutory rights relating to defective, unsafe or non-conforming goods.


13. Products Damaged by Customer Misuse

A product will not automatically qualify for a statutory defective-goods remedy where the problem resulted from the customer’s actions rather than a defect or failure covered by applicable law.

Examples may include damage resulting from:

  • Deliberate misuse;
  • Improper use;
  • Failure to follow reasonable manufacturer instructions;
  • Unauthorised modification;
  • Attempted repairs by the customer or an unauthorised person;
  • Accidental physical damage caused after delivery; or
  • Other circumstances for which the supplier is not legally responsible.

Each situation will be assessed based on the circumstances and applicable law.


14. Normal Wear and Tear

Normal wear and tear is not necessarily a product defect.

Where a product has naturally deteriorated through ordinary use and the deterioration does not amount to a defect or failure covered by applicable law, the statutory defective-goods remedies may not apply.

The assessment will depend on the nature of the product, its expected use, its age and the circumstances involved.


15. Return Request Process

To request a return, please contact us using the details below.

Please provide:

  3. Product name;
  4. Date of purchase;
  5. Reason for the return;
  6. Description of the problem, where applicable; and
  7. Photographs or videos where reasonably necessary to help us assess the issue.

16. Return Authorisation

Where a product needs to be returned to Zoltify, we will provide instructions regarding how and where the product should be returned.

Please do not send products to an address that has not been provided or confirmed by Zoltify.

This helps us ensure that returned products are correctly identified and processed.


17. Return Shipping Costs

Where a return is required because the product is defective or another statutory right places the return cost on the supplier, Zoltify will comply with the applicable law.

In particular, section 56 of the CPA provides that qualifying defective goods returned within the six-month implied warranty period may be returned at the supplier’s risk and expense. (Government of South Africa)

For voluntary change-of-mind returns that are not required by law, the customer may be responsible for reasonable return delivery costs where this was clearly communicated beforehand and is legally permissible.


18. Inspection of Returned Products

When a product is returned, Zoltify may inspect it to determine:

  • The reported problem;
  • Whether the product corresponds with the order;
  • Whether there is a defect;
  • Whether the product has been damaged;
  • Whether the issue may have resulted from misuse; and
  • What remedy is applicable.

An inspection will not be used to unlawfully remove a consumer’s statutory rights.


19. Refunds

Where a refund is required or agreed, Zoltify will process the refund in accordance with applicable law and the circumstances of the return.

Where reasonably possible, refunds will generally be made using the original payment method.

Depending on the payment provider, bank or payment method, it may take additional business days for the refunded amount to appear in the customer’s account.


20. Refund for Defective Goods

Where the CPA gives the consumer a right to a refund for qualifying defective goods, Zoltify will provide the applicable refund in accordance with the Act.

The CPA provides that, within the six-month implied warranty period and where section 56 applies, the consumer may direct the supplier to repair, replace or refund the defective goods. (Government of South Africa)


21. Refunds for Cancelled Electronic Transactions

Where a consumer validly exercises an applicable statutory cancellation right for an electronic transaction, Zoltify will process the applicable refund in accordance with the relevant legal requirements.

Any applicable statutory exceptions will be taken into account.


22. Shipping Charges and Refunds

Where a return or refund is required because of a defective, incorrect or otherwise non-conforming product, any applicable shipping or return costs will be handled in accordance with the consumer’s statutory rights.

For voluntary returns that are not required by law, the treatment of original and return shipping costs will depend on the applicable voluntary return arrangement communicated to the customer.


23. Free Shipping Promotions

If an order qualified for a free-shipping promotion, the treatment of shipping charges following a voluntary return may depend on the terms of the relevant promotion.

However, promotional conditions will not be applied in a manner that removes or limits statutory consumer rights.


24. Exchanges

Where permitted or appropriate, Zoltify may offer an exchange for another product.

For defective products, the consumer’s statutory rights will apply.

Where the CPA gives the consumer the right to choose between a repair, replacement or refund, Zoltify will respect that right subject to the requirements of the Act.


25. Gift Purchases

If a product was purchased as a gift, the original purchaser may be required to provide the order information or proof of purchase necessary to process a return or refund.

Statutory consumer rights remain applicable regardless of whether the product was purchased as a gift.


26. Proof of Purchase

We may request reasonable proof that the product was purchased from Zoltify.

Proof of purchase may include:

  • Order confirmation;
  • Order number;
  • Invoice;
  • Payment confirmation;
  • Email confirmation; or
  • Other reasonable transaction information.

We will not use unreasonable proof-of-purchase requirements to unlawfully prevent a consumer from exercising a statutory right.


27. Products Purchased Through Other Sellers

This policy applies only to products purchased directly from Zoltify.

If you purchased a Zoltify-branded or similar product from another retailer or marketplace, you should contact the seller from whom you purchased the product.


28. Manufacturer Warranties

Some products may carry a manufacturer’s warranty in addition to your statutory consumer rights.

A manufacturer’s warranty may provide additional protection for a period specified by the manufacturer.

A manufacturer’s warranty does not replace or reduce mandatory rights under the CPA.


29. Refunds for Unavailable Products

If Zoltify accepts an order but subsequently becomes unable to supply the product, we will contact you where reasonably possible.

Where a refund is required, we will process the applicable refund in accordance with South African law.


30. Returns of Products Subject to Special Conditions

Certain products may have specific return requirements because of their nature, safety requirements, software licensing, hygiene considerations or other applicable legal or manufacturer requirements.

Any such conditions will be communicated to the customer where relevant.

They will not override statutory rights relating to defective, unsafe or non-conforming goods.


31. No “No Returns or Refunds” Policy

Zoltify does not operate a blanket “no returns or refunds” policy.

Where South African law gives a consumer a right to return goods or obtain a refund, repair or replacement, Zoltify will comply with that right.
